Unauthorized Isuzu dealers to face legal action
MANILA: Isuzu Philippines Corporation (IPC) issued a legal notice against the unauthorized use of the trademark "Isuzu" and other related brands. The company warned that they would take legal action against violators.
In a notice issued through the Ortega Bacorro Odulio Calma & Carbonell Law Firm, IPC emphasized that Isuzu Motors Limited (IML) in Japan is the "registered owner of the trademark Isuzu and related marks worldwide," including the Philippines. Furthermore, it is stated that Isuzu Philippines Corporation is the "duly-authorized distributor and assembler of Isuzu products in the Philippines" under the Assembler Distributor Agreement between IML and IPC.
The notice came after the company discovered unscrupulous business activities in the Philippines, which involved "entities" offering brand-new Isuzu cars without the required authorization.
The automaker said, "IML and IPC have not authorized other individuals/entities to conduct distribution, marketing, or sales activities outside of the IPC dealership network."
Isuzu warned. "Any unauthorized use or infringement of the trademark Isuzu and related marks, or adopting any confusingly similar mark, will be dealt with and prosecuted to the fullest extent of the law. All violators must cease and desist from conducting such unlawful acts, which include unauthorized sale, offering for sale, distribution, importation, advertising, and other preparatory steps necessary to carry out the sale of goods or services."
In other words, only Isuzu Philippines and its authorized dealers are legally allowed to import, sell, distribute, advertise, and perform related dealings on Isuzu vehicles, products, and services within the country.
Isuzu Philippines reminds the public that as the official distributor, they ensure that their brand new vehicles strictly comply with the specifications of Isuzu Motors Limited in Japan. These cars, they added, are fitted with genuine Isuzu parts and include aftersales service so they can continue to receive care and maintenance after being sold by authorized dealers.
Isuzu says they cannot guarantee that the same level of quality and care has in cars bought from non-authorized dealers, entities, and individuals. They also cannot ensure the authenticity of parts and aftermarket services to said vehicles.
